These Website Terms and Conditions (“Terms”) govern your access to and use of WaterDamageTN.com and its content, telephone numbers, referral features, search tools, and related functionality (collectively, the “Website”).
The Website is owned or operated by Iron Rock, LLC (“Iron Rock,” “Water Damage TN,” “we,” “us,” or “our”).
By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
1. Purpose of the Website
Water Damage TN is an informational, advertising, referral, and lead-connection website intended to help users locate independent companies that may provide water-damage-related services in Tennessee.
Water Damage TN is not itself a water damage restoration, remediation, mitigation, repair, construction, plumbing, mold removal, insurance, engineering, or emergency-response company.
Water Damage TN does not perform services at homes, businesses, or other properties. It does not employ, supervise, control, or direct the companies to which users may be connected.
2. No Emergency Service Guarantee
Water damage may present urgent safety, electrical, structural, sanitation, or health concerns. The Website is not a substitute for emergency services or professional safety advice.
If there is an immediate threat to life, health, or safety, contact 911 or the appropriate local emergency authority.
Water Damage TN does not guarantee:
- That a call will be answered immediately;
- That a provider will be available;
- That a provider will respond within a particular time;
- That emergency or same-day service will be offered;
- That a particular ZIP code or location is within a provider’s service area; or
- That the Website or telephone routing system will operate without interruption.
3. Independent Service Providers
Companies reached through telephone numbers, links, or referral features on the Website are independent third parties.
Water Damage TN does not represent or warrant that any service provider:
- Is licensed, bonded, insured, certified, or qualified;
- Has passed a background check;
- Is available in a particular area;
- Will accept a particular job;
- Will charge a particular price;
- Will work with a particular insurer;
- Will provide any warranty;
- Will comply with an estimated schedule; or
- Will perform services to a particular standard.
Any agreement for inspection, cleanup, restoration, remediation, repair, construction, payment, financing, warranty, or other services is solely between you and the independent provider.
Before hiring a provider, you are responsible for evaluating the provider and verifying any license, insurance, certification, experience, references, pricing, scope of work, warranty, and other information important to you.
4. No Agency, Partnership, or Endorsement
A referral or telephone connection does not create an employment, agency, franchise, partnership, joint venture, fiduciary, or contractor relationship between Water Damage TN and any service provider.
Unless expressly stated otherwise, the appearance of a provider, trade name, advertisement, telephone number, link, or other third-party content on the Website does not constitute an endorsement or guarantee by Water Damage TN.
Water Damage TN does not have authority to enter into agreements on behalf of an independent provider, and no provider has authority to make promises or representations on behalf of Water Damage TN.
5. Calls and Call Routing
Telephone numbers displayed on the Website may use dynamic number insertion, location-based routing, advertising attribution, or other call-tracking technology.
Calls may be routed based on factors such as:
- The caller’s approximate geographic location;
- The telephone number dialed;
- The ZIP code or service area involved;
- Provider availability;
- The webpage or advertisement that generated the call; or
- Other technical or business routing criteria.
Routing a call to a provider does not mean that the provider serves the caller’s location or is able to accept the requested work.
Calls may be monitored, recorded, or transcribed by CallRail, the receiving provider, or another telephone-service vendor when those features are enabled. Where legally required, notice or consent should be provided during the call.
6. No Purchases Through the Website
Water Damage TN does not currently sell products or services through the Website and does not accept payments through the Website.
Because Water Damage TN does not process Website purchases, it does not provide Website refunds or cancellations.
Any payment, deposit, cancellation, financing, refund, chargeback, or billing dispute concerning services performed by an independent provider must be addressed directly with that provider and is governed by the agreement between you and the provider.
7. Informational Content
Website content is provided for general informational and referral purposes only.
Although we may attempt to keep the Website accurate and current, information may be incomplete, inaccurate, outdated, unavailable, or subject to change. This may include information concerning:
- Service areas;
- ZIP-code coverage;
- Provider availability;
- Response times;
- Water damage processes;
- Insurance considerations;
- Provider qualifications;
- Telephone routing; and
- General property or safety information.
You should not rely on Website content as professional, engineering, construction, environmental, insurance, legal, medical, or emergency advice.
8. Insurance and Coverage Disclaimer
Water Damage TN does not determine insurance coverage, interpret insurance policies, negotiate claims, guarantee reimbursement, or act as a public adjuster, insurance agent, or insurer.
Statements made on the Website or by an independent provider concerning insurance are not guarantees that an insurer will cover a claim.
Questions about coverage, deductibles, claims, reimbursement, or policy requirements should be directed to your insurer or an appropriately qualified professional.
9. ZIP-Code and Service-Area Tools
The Website may include a ZIP-code or location-search tool intended to provide a preliminary indication of whether a provider may serve an area.
Search results are not guarantees of coverage or availability. Service boundaries, staffing, travel limitations, weather, emergencies, provider decisions, and other circumstances may affect whether service is actually available.
A “service available” result does not create an obligation for any provider to accept a call or job. A “service unavailable” result does not guarantee that no provider serves that area.
10. Acceptable Use
You may use the Website only for lawful purposes.
You may not:
- Use the Website to commit fraud or another unlawful act;
- Interfere with the Website, servers, telephone-routing systems, or security features;
- Attempt to gain unauthorized access to any account, system, database, or restricted administrative area;
- Introduce malware, malicious code, automated attacks, or harmful material;
- Scrape, crawl, harvest, or extract Website data through unauthorized automated means;
- Use Website telephone numbers for harassment, spam, solicitation, or abusive calls;
- Impersonate another person or misrepresent your identity;
- Use the Website in a manner that infringes another person’s rights; or
- Assist another person in engaging in prohibited conduct.
We may restrict or terminate access to the Website when we reasonably believe a user has violated these Terms or poses a security or legal risk.
11. Intellectual Property
The Website and its original text, graphics, design, layout, logos, databases, software, and other content are owned by or licensed to Iron Rock and are protected by applicable intellectual-property laws.
You may access and use the Website for personal, noncommercial purposes related to locating service providers.
You may not reproduce, republish, distribute, modify, create derivative works from, sell, license, frame, mirror, or commercially exploit Website content without prior written permission, except as permitted by law.
Third-party names, logos, and trademarks remain the property of their respective owners. Their appearance on the Website does not transfer ownership or grant you a license to use them.
12. Third-Party Websites and Content
The Website may include links to third-party websites, advertisements, telephone services, or other resources.
We do not control and are not responsible for third-party content, availability, privacy practices, security, terms, products, services, or representations.
Your dealings with a third party are solely between you and that third party. You should review the third party’s applicable terms, privacy policy, credentials, and service agreement.
13. Privacy
Your use of the Website is also subject to the Water Damage TN Privacy Policy.
The Privacy Policy explains how information may be collected through analytics, advertising, call-tracking, telephone-routing, cookies, and similar technologies.
14. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE, ITS CONTENT, TELEPHONE NUMBERS, ROUTING FEATURES, SEARCH RESULTS, REFERRALS, AND RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
IRON ROCK DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RESULTS.
WE DO NOT WARRANT THAT:
- THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
- DEFECTS WILL BE CORRECTED;
- INFORMATION WILL BE COMPLETE OR ACCURATE;
- A SERVICE PROVIDER WILL BE AVAILABLE;
- A PROVIDER WILL ACCEPT OR COMPLETE A JOB;
- A PROVIDER’S WORK WILL MEET YOUR EXPECTATIONS;
- A CALL WILL BE ROUTED TO A PARTICULAR PROVIDER; OR
- USE OF THE WEBSITE WILL PREVENT OR REDUCE PROPERTY DAMAGE.
Some jurisdictions do not allow the exclusion of certain warranties, so portions of this section may not apply to you.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IRON ROCK AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, USE, PROPERTY, OR BUSINESS OPPORTUNITY.
THIS LIMITATION APPLIES TO CLAIMS ARISING FROM OR RELATED TO:
- USE OF OR INABILITY TO USE THE WEBSITE;
- WEBSITE ERRORS, INTERRUPTIONS, OR SECURITY INCIDENTS;
- TELEPHONE ROUTING OR CALL-TRACKING SERVICES;
- DELAYED, MISROUTED, UNANSWERED, OR DISCONNECTED CALLS;
- A PROVIDER’S AVAILABILITY, CONDUCT, PRICING, STATEMENTS, WORK, OMISSIONS, OR SERVICES;
- PROPERTY DAMAGE, MOLD, CONTAMINATION, STRUCTURAL CONDITIONS, OR OTHER CONDITIONS AT A PROPERTY;
- RELIANCE ON WEBSITE CONTENT OR SEARCH RESULTS; OR
- THIRD-PARTY WEBSITES OR SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, IRON ROCK’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
16. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Iron Rock and its members, managers, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising from:
- Your unlawful or improper use of the Website;
- Your violation of these Terms;
- Your infringement of another person’s rights; or
- Information or materials you provide through your interaction with the Website.
This section does not require you to indemnify a party for conduct for which indemnification is prohibited by law.
17. Changes to the Website
We may modify, suspend, withdraw, restrict, or discontinue any portion of the Website at any time without notice.
We may change telephone numbers, routing methods, service-area information, providers, content, and Website functionality.
We are not liable if any portion of the Website is unavailable or changed.
18. Changes to These Terms
We may update these Terms from time to time.
The updated Terms will be posted on the Website with a revised effective date. Your continued use of the Website after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
19. Governing Law and Jurisdiction
These Terms and any dispute arising from or relating to the Website will be governed by the laws of the State of Tennessee, without regard to conflict-of-law rules.
Any legal action arising from or relating to these Terms or the Website must be brought in a state or federal court with lawful jurisdiction in Tennessee, unless applicable law requires another forum.
You consent to the personal jurisdiction of those courts.
20. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law or severed if necessary.
The remaining provisions will remain in effect.
21. No Waiver
A failure to enforce any provision of these Terms does not waive the right to enforce that provision or another provision later.
22. Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and Iron Rock concerning use of the Website and supersede prior discussions or understandings concerning the Website.
These Terms do not replace or modify any separate agreement between you and an independent service provider.
